Pro Drivers Academy – Terms and Conditions
By enrolling in Pro Drivers Academy, students agree to abide by the terms and conditions outlined herein. These terms are designed to ensure safety, professionalism, and fairness for both instructors and students.
1. Road Traffic Act 1988
Students must:
• • Hold a valid provisional driver’s licence.
• • Obey all traffic laws and regulations while learning to drive.
• • Follow all instructions and guidance provided by their driving instructor.
• • Maintain focus and attention on the road during driving lessons.
• • Respect the rights of other road users and pedestrians.
• • Inform the driving instructor of any medical conditions or impairments that may affect their ability to drive safely.
• • Take responsibility for their actions and decisions while operating a vehicle.
2. Health and Safety Regulations
• • All Pro Drivers Academy instructors hold a valid DVSA-approved driving instructor licence.
• • Vehicles used for instruction are registered, insured, and maintained in a safe, roadworthy condition.
• • All vehicles are equipped with dual controls and relevant safety features.
• • Students must comply with all safety regulations and instructor instructions. Failure to do so may result in immediate lesson termination without refund.
• • The instructor reserves the right to terminate any lesson if the student appears unfit to drive due to alcohol, drugs, fatigue, emotional distress, or any other cause compromising safety. In such cases, the lesson will be charged in full.
3. Dash Cam and Data Protection Compliance
• • Vehicles are equipped with dash cameras that record both the front exterior and the vehicle’s interior for safety, training, and security purposes.
• • Recordings may be reviewed in the event of an incident, dispute, or complaint.
• • Recordings are handled in accordance with the UK GDPR and Data Protection Act 2018.
• • Recordings are stored securely and accessed only by authorised personnel, and are automatically overwritten after a limited retention period.
• • Recordings will not be active during DVSA driving tests.
• • By enrolling, students consent to being recorded for legitimate safety and training purposes.
4. Insurance and Liability
• • All vehicles used for instruction are fully insured for tuition purposes.
• • Insurance coverage does not extend to students using their own vehicles unless agreed otherwise.
• • Pro Drivers Academy shall not be liable for losses exceeding the level of our insurance coverage.
5. Student Conduct and Responsibilities
• • Students must bring a valid provisional driving licence to all lessons.
• • Students must meet the eyesight requirement (reading a number plate from 20 metres).
• • Students must behave respectfully toward instructors and other road users.
• • Aggressive, abusive, or disruptive behaviour may result in immediate termination of the lesson and/or contract without refund.
• • Students are responsible for any vehicle damage caused due to negligence, reckless driving, or failure to follow instructor instructions.
• • Students are responsible for any penalties, fines, or offences committed while in control of the vehicle.
6. Payment, Cancellations, and Refund Policy
• • All payments must be made in full prior to lesson scheduling unless otherwise agreed.
• • Instalment plans may be considered upon request.
• • Cancellations or reschedules must be made at least 48 hours in advance via phone or text and confirmed by the instructor.
• • Failure to provide sufficient notice will result in the lesson being charged in full.
• • If a student fails to arrive at the pickup location within 10 minutes of the agreed time without contact, the lesson will be charged in full.
• • If an instructor cancels or delays a lesson due to unforeseen circumstances, no charge will apply or the missed time will be rescheduled.
7. Driving Test Vehicle Availability and Policy
• • Use of the instructor’s vehicle for the DVSA driving test is at the instructor’s discretion.
• • The instructor may refuse use of the vehicle if the student is deemed unsafe, unprepared, or unfit to drive.
• • If a student books an earlier test through a third party and pays an additional fee, this cost will not be reimbursed.
• • If the vehicle is unavailable due to unforeseen circumstances, the maximum refund is the standard test fee (£62). No further compensation will be provided.
8. Force Majeure
• • Pro Drivers Academy shall not be held liable for any failure or delay in providing lessons due to circumstances beyond its control, including but not limited to extreme weather, illness, accidents, or road closures.
9. Communication and Complaints
• • All bookings, cancellations, and schedule changes must be confirmed directly with the instructor by phone or text.
• • A booking is not confirmed until acknowledged by the instructor.
• • Any complaints or disputes should be raised within 7 days of the incident for timely resolution.
10. Intellectual Property
• • The name ‘Pro Drivers Academy’ and all associated materials are the intellectual property of the business owner and may not be copied, used, or reproduced without written permission.
11. Amendments to Terms and Conditions
• • Pro Drivers Academy reserves the right to modify these Terms and Conditions at any time.
• • Notice of changes will be communicated to enrolled students via email or other suitable means.
Acknowledgement and Agreement
By enrolling in Pro Drivers Academy, students acknowledge that they have read, understood, and agree to these Terms and Conditions.
